ATF has noted a significant increase in such requests since 2004, often in connection with rifle models that were, until 2004, defined as “semiautomatic assault weapons” and prohibited under the Public Safety and Recreational Firearms Use Protection Act, 18 U.S.C. 921 (sunset effective Sept. 13, 2004). Accordingly, these devices are included under the definition of “machinegun” and, therefore, come within the purview of the NFA. regulations at the Bureau of Alcohol, Tobacco, Firearms and Explosives to classify bump stocks as “machine guns” under the National Firearms Act of 1934 and amendments to the Gun Control Act of 1968, rendering them illegal under federal law.
